Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Scallop Bay Shellfish Company, LLC farm data collection system at data.scallopbayshellfish.com (the “Service”) and our SMS/text-message notification program. By accessing the Service or consenting to receive text messages from us, you agree to these Terms.

1. Eligibility and authorized use

The Service is a private, internal tool for the owner, employees, and authorized personnel of Scallop Bay Shellfish Company, LLC. Access is granted by the company and may be revoked at any time. You agree to use the Service only for legitimate business purposes and to keep your login credentials confidential.

2. The Service

The Service allows authorized users to record and review hatchery, nursery, farm, and related operational data, and to receive operational notifications. We may modify, suspend, or discontinue any part of the Service at any time.

3. SMS / text messaging terms

• Program description. Scallop Bay Shellfish Company, LLC sends operational and service-related text messages (such as daily-check confirmations and missed-check reminders) to the business owner and authorized staff who have consented to receive them.
• Consent. Enrolling in text messages is optional and is never required to use the Service or as a condition of employment. You consent to receive these messages only by separately and voluntarily checking the optional SMS opt-in box on our sign-up page; providing your mobile number alone does not enroll you. We do not send marketing or promotional messages.
• Message frequency. Varies based on operational activity.
• Cost. Message and data rates may apply, per your mobile carrier plan.
• Opt-out. Reply STOP at any time to stop receiving messages; you may receive a final confirmation.
• Help. Reply HELP for assistance, or contact dan@scallopbayshellfish.com.
• Carriers. Wireless carriers are not liable for delayed or undelivered messages.
• Your information is handled in accordance with our Privacy Policy.

4. Acceptable use

You agree not to misuse the Service, attempt unauthorized access, interfere with its operation, or use it to violate any law.

5. Intellectual property

The Service, including its software, design, and content, is owned by Scallop Bay Shellfish Company, LLC and may not be copied or redistributed without permission.

6. Disclaimer

The Service is provided “as is” without warranties of any kind. We do not warrant that it will be uninterrupted or error-free.

7. Limitation of liability

To the maximum extent permitted by law, Scallop Bay Shellfish Company, LLC is not liable for any indirect, incidental, or consequential damages arising from use of the Service or the messaging program.

8. Changes to these Terms

We may update these Terms from time to time. The effective date above reflects the latest revision; continued use constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
